The European Securities and Markets Authority (ESMA) has today opened a call for evidence on the Alternative Investment Fund Managers Directive (AIFMD). ESMA has to develop an Opinion under the AIFMD on the functioning of the EU passport and the functioning of the marketing of non-EU AIFs by EU AIFMs in the EU and the management and/or marketing of AIFs by non-EU AIFMs in the EU.
Besides its Opinion, ESMA must also issue advice on whether the passporting regime should be extended to the management and/or marketing of AIFs by non-EU AIFMs and to the marketing of non-EU AIFs by EU AIFMs. The aim of this call for evidence is to gather input on the key issues that will determine the orientation of ESMA’s opinion.
ESMA will consider all responses received by 8 January 2015.
